Daron Tooch focuses on managed care litigation and has recovered hundreds of millions of dollars for healthcare providers in civil actions and arbitrations against health plans, having tried over 100 cases before juries, judges and arbitrators in federal, state and administrative courts. He represents hospitals, medical groups, physicians, pharmacies, laboratories, surgery centers and home health companies in arbitrations and in federal and state courts. In 2017, he obtained the second highest verdict for breach of contract claims in California. Tooch has successfully represented a number of hos-pitals challenging out-of-network payments by health plans. Under California law, health plans are required to pay hospital a reasonable value for emergency and post-stabilization services to health plan members. Tooch has repeatedly challenged health plans for not paying reasonable amounts. In January, Tooch obtained a verdict of $105,887,963 for Pomona Valley Hospital against Kaiser that amounted to 77.5% of its charges.
