A federal judge dismissed a lawsuit Wednesday against Herbalife Ltd. and Chief Executive Officer Michael Johnson in which the company was accused of defrauding shareholders by misrepresenting that it had complied with laws aiming to prevent pyramid schemes, according to Reuters.
Los Angeles District Court Judge Dale Fischer ruled the Oklahoma Firefighters Pension and Retirement System failed to show that Herbalife intended to deceive investors.
Fischer had also previously dismissed two earlier versions of the lawsuit.
Upon news of the ruling, Herbalife executives issued this statement: “For the third time, the judge has ruled in our favor, this time dismissing the claims with prejudice. We are obviously pleased with the judge’s decision.”
