In-N-Out Burgers Inc. terminated its longtime Corporate Vice President Richard Boyd and removed him from its board Tuesday following a monthslong dispute with the heirs of company matriarch Esther Snyder.

Boyd, co-trustee of Snyder’s estate, alleged in suits filed late last year that Snyder’s heir, Lynsi Martinez, was trying to oust him and take over company operations. The suits are pending in L.A. Superior Court.

Irvine-based In-N-Out responded by filing a suit Jan. 10 accusing Boyd of embezzlement and fraud, including the use of company construction crews as part of a $2 million remodel of his home. He was removed from his posts at a board meeting Tuesday.

“In-N-Out had attempted to facilitate Mr. Boyd’s departure from the company in an amicable manner,” said the burger chain’s general counsel Arnold Wensinger, in a prepared statement. “He, however, chose to launch a vicious and baseless attack on a company and family whose best interests he had been appointed to protect.”

Boyd’s attorney, Philip Heller of Fagelbaum and Heller LLP, had sought an injunction to stall the meeting, but the injunction was denied by an L.A. Superior Court judge.

“This whole procedure is indefensible and we intend to contest what took place. It won’t withstand scrutiny and it won’t hold,” said Heller, who claimed Boyd was denied entrance to the meeting.

Founded in 1948 by Snyder and her husband, Harry, In-N-Out opened its first restaurant in Baldwin Park, which is home to its museum, training center and some executive offices. Since then, In-N-Out has steadily added restaurants and now has 202, according to its Web site.
