One of California’s leading litigators, Scott Malzahn is managing partner of Waymaker LLP. He has a complex commercial litigation practice that spans intellectual property, fintech and class actions in the securities arena. In 2024, Malzahn and the Waymaker team won a
$18.3 million award in a trade secret theft case and he recently tried another confidential dispute in an arbitration. In addition to his trial experience, Malzahn has handled – and won – high-pro-file disputes through motion practice before the trial court and on appeal. Among others, he crafted the winning legal arguments adopted unanimously by the California Supreme Court in FilmOn, Inc. v. Double-Verify, Inc., which established a new legal test to govern anti-SLAPP cases under the catchall provision.
