Widely regarded in the insolvency world as the “involuntary bankruptcy go-to lawyer,” Steve Gubner, managing partner at BG Law, is known for adeptly managing sensitive issues surrounding involuntary bankruptcy filings, as well as helping clients navigate potential pitfalls and solve problems before they occur. He is also known for creating novel law. A recent case and an important win Gubner obtained for his client, directly led to the creation of a new law that prohibits non-disclosure agreements obligations from being discharged in a bankruptcy. In a case of first impression, with no prior on-point decision anywhere in the country, he persuaded the US Bankruptcy Court for the Southern District of New York to rule that NDA obligations were not “claims,” and because only “claims” are subject to being discharged in bank-ruptcy, NDA obligations cannot be discharged.
