Todd Toral’s career successes in complex matters on behalf of clients speak for themselves. In 2021, Toral and team secured the dismissal of a putative class action against Marriott arising from a property system incident. Following an investigation, Marriott confirmed that no sensitive information, such as social security numbers, credit card information, or passwords, was compromised in the incident. Judge David O. Carter dismissed all plaintiff claims, which included asserted violations of California’s unfair competition law and the California Consumer Privacy Act (CCPA), because “sensitive information” was not involved. The ruling set a precedent for standing-based dismissals under the CCPA, which had only been in effect for one year when the decision was issued.
Toral also led an arbitration in Montreal in which the arbitrators upheld and renewed a trademark license agreement in favor of his clients, petitioners 79411 USA Inc. (Fix Auto USA) against respondent Mondofix.
