William Delgado is a seasoned litigator and a leader in the class action and IP arenas, representing names such as Costco, Target, American Honda, Walgreens, Ticketmaster, Penske Media Corporation, and Nature’s Bounty. In a recent matter, he served as lead counsel representing American Honda (beginning as three different class actions in Alabama, California, and New Jersey) alleging that Honda vehicles incorporated a defective fuel pump. He obtained a stay of the California suit, and two were consolidated last year. He also secured a victory in a suit alleging a Honda motorcycle had a design flaw. He filed a demurrer arguing that the dealer agreement contained a choice-of-law provision identifying California law including California’s statute of limitations, and that plaintiffs could not displace California law with Missouri’s law, which had a longer limitations period. Court agreed with AHM’s statute of limitations argument, sustaining the demurrer with leave to amend.
