Two years after making national news for banning the sale of fur products in the city, West Hollywood has made its fur ban ordinance tougher, while also creating a loophole that could allow some fur sales in the city.

The City Council amended the fur ban Monday to outlaw the display of fur merchandise. While illegal to sell fur in West Hollywood, many retailers found a way around the ban by displaying fur products and telling interested customers they could purchase the items online or at stores in other jurisdictions.

At the same meeting, the city also approved the sale of fur caught under the authority of a California trapping license.

That decision came after the California Superior Court ruled that the city ban violated part of the state’s fish and game code, which mandates that certain fur products in California can be purchased and sold at any time. The ruling was the result of a suit filed by West Hollywood boutique Mayfair House, which sued the city shortly after the ban was first put in place.

David Fink, Mayfair’s attorney, said the loophole allowing the sale of fur caught legally in California weakens the ban and will make it harder to enforce.

“The exemptions written into the new fur ban ordinance now allow a wide array of fur products to be sold in West Hollywood apparel stores, and will make it virtually impossible to enforce the ordinance against non-exempt fur products,” Fink said in a statement Thursday.
