A popular sandwich chain sued actor Jerry Ferrara Tuesday in an attempt to expel the celeb from the ownership group alleging he undermined the restaurant and breached his contract.
The lawsuit filed on behalf of entities that control the Fat Sal’s Deli chain alleges Ferrara – best known as Turtle on HBO’s hit series “Entourage” – failed to uphold his end of a licensing agreement and “showed little interest” in the sub slinging business.
The complaint, filed in Los Angeles Superior Court, alleges Ferrara holds a 33 percent stake in the initial restaurant venture for which he paid $74,500 and 25 percent stake in a licensing venture associated with Fat Sal’s.
The suit claims Ferrara routinely complained about his deal with the sandwich shop’s founders, Salvatore Capek and Joshua Stone, and shirked the promotional duties he was supposed to perform as a condition of his partnership stake despite receiving almost $200,000 in distributions based on his investment.
“Ferrara would often intentionally withhold his promotional efforts for significant periods of time when he became ‘unhappy’ and ‘frustrated’ that he didn’t have enough ownership interest in Fat Sal’s restaurants other than (the original location),” the complaint reads.
Ferrara’s publicist did not immediately respond to request for comment.
The complaint details a deteriorating relationship between the founders and Ferrara – who is allegedly threatening legal action himself – after the actor demanded Capek and Stone give him equity in a third entity the pair controlled. The complaint said Ferrara’s brother Anthony demanded the increased stake because Jerry had “the world’s shittiest deal.
