Jonathan Kagan regularly advises clients in high- stakes, complex litigation. Among his victories, as co-lead counsel, Kagan recently scored a string of major defense wins for Juniper Networks in hard-fought cybersecurity patent litigation against Finjan. He persuaded the Federal Circuit to affirm a trial victory he obtained for Juniper, and then convinced the trial court that the case was exceptional, resulting in Finjan being ordered to foot $5.9 million of Juniper’s attorneys’ fees. The Federal Circuit affirmed the fees ruling.
The victory, including the fees award, was particularly rewarding for Juniper because Finjan has been dubbed by Bloomberg as “Cybersecurity’s Top Patent Litigator,” and its success has caused many of its other targets to capitulate to its financial demands rather than present a full-scale defense. Kagan’s other recent wins include securing a favorable confidential settlement for Juniper in an infringement suit.
