The U.S. District Court for the Central District of California has ordered that a Mid-City Los Angeles seafood company, Neptune Manufacturing Inc., shut its business and destroy all its seafood until it puts in place an approved food-safety program, the U.S. Department of Justice announced Thursday.

The order came in connection with a complaint brought before the court by the department last month on behalf of the U.S. Food and Drug Administration, which alleged Neptune’s fish products had the potential to be contaminated with bacteria based on several inspections that found unsanitary conditions at the facility.

The particular bacterium found at Neptune, Listeria monocytogenes, causes listeriosis, which can be fatal to newborns, the elderly and those with an impaired immune system.

Neptune’s corporate officers, Alexander Goldring, Peter Oyrekh and Semyon Krutovsky, who were also named in the compliant, have agreed to settle the lawsuit and be bound by the court’s order.

The order makes some hefty requirements, including that the company hire food safety experts and independent laboratories to clean and sanitize Neptune’s facility, conduct environmental sampling and develop and put into place new bacteria monitoring, food safety and employee training programs. The FDA must inspect the facility and approve all new plans.

Neptune is also required to recall all its food. The company prepares, processes, packs and distributes several types of ready-to-eat smoked and salt-cured fish to customers in Southern California and Las Vegas.

According to the complaint, FDA has inspected the facility seven times since 2006 and repeatedly found Listeria and unsanitary conditions.

No illnesses have been reported to date associated with Neptune’s products, according to the FDA notice.
