Former Gemstar CEO Charged Again

The now-missing former chief executive of Gemstar-TV Guide International Inc., Henry Yuen, was charged by the U.S. Justice Department with obstructing an investigation into accounting irregularities at the media company he ran.


Yuen on Tuesday was charged with a felony count of obstructing a Securities and Exchange Commission probe into alleged irregularities at Gemstar from 1999 through 2002.


Yuen used software to delete documents from his computer that the SEC specifically sought in its investigation, making them irretrievable the day before he was scheduled to testify before the SEC in 2003, the government claims.


In 2006, Yuen withdrew his guilty plea of destroying evidence after District Judge John Walter rejected his agreement with the government, saying Yuen’s punishment of six months’ home detention, $1 million in charitable donations and a $250,000 fine was too lenient.


Yuen settled in Feb. 2006 and was ordered to pay $22.3 million in fines and restitution. The whereabouts of Yuen are unknown. He faces as much as five years in prison if convicted on the obstruction charges.


Gemstar was acquired earlier this month by software developer Macrovision Corp. for $2.3 billion.
