said it was notified by the Securities and Exchange Commission that President and Chief Operating Officer Carlos Alberini may face civil charges for violating securities laws while working as the former financial chief at Footstar Inc., a Mahwah, N.J. based footwear retailer that emerged from bankruptcy on Feb. 7. The SEC inquiry is not directed at the management of L.A.-based Guess.

The SEC issued notices to Footstar and Alberini saying it was considering pursuing action against them. Guess said in a regulatory filing Alberini plans to try to persuade the SEC that no such action should be commenced. Guess said last week that its former chief financial officer, Frederick Silny, was leaving the company in May, and that Alberini would take over the CFO responsibilities until a successor is chosen.
