Guides Say They Weren’t Paid But Had to Wait

They may know where the celebrities live, but they certainly don’t get paid like them. And now they’re looking for some payback.


Two former guides who drove tourist-packed vans to celebrity homes in Beverly Hills and Bel-Air have filed suit against their employer, Starline Tours of Hollywood, alleging that they didn’t get paid for the time spent between the two-hour tours.


Ridge Tolbert and Brian McCabe filed suit on behalf of the estimated 100 tour guides who have worked at Starline for the past four years, according to the suit. “They would be basically on call during the day, and they would not necessarily get paid for that on-call,” said Eric Kingsley, a partner at Kingsley & Kingsley PC who represents the tour guides.


Sometimes the tours got canceled because of seasonal circumstances or adverse weather. In those circumstances, the guides, who earned $26 per tour, still had to report to work but did not get paid.


“They’re just basically sitting around under an employer’s control and getting paid zero compensation,” he said. “If they’re there for eight hours a day and get one tour, they could be making less than minimum wage.”


The tour guides also sued for missed meal and rest breaks, since they cannot take breaks while they are on call, Kingsley said.

A call to Starline was not returned.


In the past year, Starline has paid $6,500 in penalties to the State of California for failing to pay adequate wages to its employees. During that time, the state’s Department of Industrial Relations’ Division of Labor Standards Enforcement has brought five cases on behalf of five separate employees alleging a total of $11,809 in unpaid wages against the company. One claim was dropped, but the company faces $4,900 in two remaining claims.


Starting at Grauman’s Chinese Theatre on Hollywood Boulevard, the tour takes passengers to Rodeo Drive, the Sunset Strip, the Playboy Mansion and the homes of celebrities, including Nicolas Cage, Steve Martin, Harrison Ford and Tori and Aaron Spelling.
