Jackson Estate Sues Foundation

Michael Jackson’s estate filed suit in U.S. District Court in Los Angeles against the Heal the World Foundation, accusing the entity of trademark infringement, cyber-squatting and using entertainer’s name and likeness without permission to deceive the public into assuming that it operates a Jackson-sanctioned charity.

Jackson in 1992 established his own Heal the World Foundation, named after the hit song that was used to raise money for worldwide hunger relief. But that foundation became inactive prior to the entertainer’s death in June. John McClain and John Branca, special administrators for the Jackson estate, said in the suit that the organization now using the name to solicit donations has no connection to the real foundation.

The defendants have registered for six trademarks and applied for 41 additional ones, according to the suit, which was filed late Tuesday. Those applications “uniquely and unmistakably point to Mr. Jackson and his persona” and are intended “to cause confusion, mistakes and to deceive.” In addition, the suit said Heal the World is cyber-squatting by establishing midleading domain names such as “mjaid.net,” “mjquotes.net” and “healtheworldfoundation.net.”

The suit names as defendant the Heal the World Foundation and an affiliated corporation, United Fleet, which operates in Indio and Palm Desert. A Melissa Johnson runs a home health care business out of offices listed for the foundation, according to the lawsuit.

Neither Johnson nor United Fleet officials could be reached for comment.
