Blue Holdings Files Copyright Infringement Suit

Blue Holdings Inc., manufacturer of high-end Antik Denim LLC, said Wednesday that it has begun an aggressive campaign to prevent counterfeiting of Antik’s signature back pocket design.


The Commerce-based apparel company filed a lawsuit alleging copyright infringement this week against Turn On Products Inc. and Alloy Inc. in the U.S. District Court in downtown Los Angeles. The company expects to file at least three similar suits before the end of the week.


The lawsuit alleges that the companies sold clothes with replications of Antik’s elaborate pocket design in violation of federal and state trademark, copyright, and unfair trade practice laws. Back pocket designs are used to distinguish premium jean brands.


In filing the lawsuit, Blue Holdings joins other high-end jean makers, including Vernon-based Seven For All Mankind LLC, that have sought legal action to stop their designs from being poached. Lawsuits on the part of premium denim companies that sell jeans regularly topping $100 have grown more common as expensive jeans become a staple in stores and women’s wardrobes.


Officials with Turn On and Alloy could not be reached for immediate comment.
